        Been listening to you for a long time. I appreciate the motivation. I have been buying land and placing new and newer mobile homes on this land for a few years now. Cash flow has been great but has been slowed some due to the rising value of my properties and much higher property taxes. I classified my homes as real property. I am now wanting to know if I can reclass them back to personal property? If so, will this help my cause? Are personal property taxes usually less than real property taxes? Do they still get assessed the same way annually?

With regards to your question, it looks as if you are writing from somewhere in Texas. If this is the case then definitely check out the second page of this SOL application pamphlet. https://www.mobilehomeinvesting.net/wp-content/uploads/2014/08/SOL-APPLICATION-INSTRUCTIONS1.pdf On the second page it discusses transferring ownership from real property to personal property. In my experience your thought processes correct with regards to this helping the cause of reducing the property tax bill, with that said I would definitely encourage you to double check this and get some quotes on the amount of taxes you will be paying for the land and for the individual homes on top of the property. I mention this because I do not want to give you any wrong or misleading information depending on your county or particular situation. If I understand you correctly you have a question about personal property trusts and how to use them. I’m not sure if you meant to say “fill” a document with the county or state, or “file” a document with the county or state. The answer to both these questions are, “it depends”. However most times our personal property trust should be filed with the state that the home is being purchased in. I hope this helps and answers your question.     I have checked you out on you tube, etc. I’m really impressed with the clarity in which you present your information plus you seem to operate with a high degree of professionalism and integrity. I’m likely to purchase your class. My concern is with the requirements of Dodd Frank in terms of how it restricts seller financing, is there a reasonable work around that investors are using? I just want to get a good sense that a beginner like me is not going to waste a lot of time and money and the get stuck not being able to sell any properties via seller financing.

    I’m not looking for a legal opinion or anything like that… just want to know how you and others who are experienced are handling Dodd Frank.

      Thank you for taking the time to reach out and connect. I apologize about the delay in this comment reply. The Dodd Frank act and other truth in lending acts absolutely do pertain to mobile homes on private land and inside pre-existing parks. Definitely make sure the paperwork you are using is compliant with Dodd Frank and how you are advertising and negotiating falls within the scope of these acts as well. In reality, most of us never want to take advantage of buyers or sellers. However we still have to make sure our paperwork is correct, we disclose everything, and most importantly are selling to the right low risk tenant-buyers. There is another post on this website that shares an article and a one hour audio conference phone call a Dodd Frank specialist and I had together to help others, dispense, and talk about safe ways to move forward realistically and legally.     John I spoke with you the phone about a week or so ago. I know that you encourage newbies to Mobile home investing to start in parks first. This deal kind of found me while I was visiting a friend of the family. So here’s the deal that I am looking at, –
    A 2010ish MH Foreclosed by bank or credit union,
    3 bed 2 bath,
    home on land,
    no appliances,
    needs some minor repair work ( Which I’ll Do Myself)
    not sure about taxes or anything like that,
    being sold by realtor agent
    They are asking $27,000 firm. I am not sure if this is a good deal or not.
    This would be my very first mobile home purchase. I’m not sure if I should or how I would go about making any offers. Any help or advice would be greatly appreciated.

      Very good to hear from you. Thank you for reaching out and connecting. My apologies with regards to this delay on this comment reply. Somehow your comment slip through the cracks. However I did want to reply to this comment for you and others potentially reading this thread. You’ve likely already purchased or passed on this mobile home opportunity, and I’m curious if you were able to create value with the seller. Keep in mind that noble home investing is a conveyor belt type of business with more and more sellers needing to sell down the road. The answer to your question about this being profitable is definitely, it depends. If we were working together there are about two dozen or more questions I would ask you in order to determine if this is something that we want to spend our time pursuing. 27,000 may be a very good deal or it may not. However if it is a foreclosed bank mobile home then you will likely be closing on the property yourself as it may be difficult to wholesale. Wholesaling is possible however you will have to get creative since you are working with the bank and they will want you or the buyer that is listed on the contract to actually fulfill the closing and they will not usually allow you to assign this contract. However a three-bedroom mobile home from 2010 certainly sounds like it is probably in fairly decent condition and desirable to most mobile home buyers. However in reality the answer to your question is definitely it depends. I do very much encourage you to pursue many of these opportunities to learn more and asked more questions along the way.
